Kerala HC refuses to pass interim order staying NTO 3.0

The Kerala High Court on Friday refused to entertain All India Digital Cable Federation (AIDCF)’s plea seeking a stay on Telecom Regulatory Authority of India (TRAI)’s tariff amendment – NTO 3.0 and also declined to pass any interim order in this regard.

The court , after a detailed hearing in the matter said that it was not inclined to pass any interim order staying
the contentious amendments.

The AIDCF had moved court, challenging TRAI’s tariff amendment – NTO 3.0 and sought a stay on the implementation on the new Tariff order, which is likely to come into effect from next month i.e. February 1, 2023. The AIDCF has been clamoring against the amendments and demanding that it be struck down.

TRAI was represented by Mr. Rakesh Dwivedi, Sr. Advocate, who pressed for the Writ Petition to be dismissed as the amendments were carried out after detailed consultation with the stakeholders and after the power of regulatory authority has been upheld by the Supreme Court.

The Indian Broadcasting & Digital Foundation (IBDF) was represented by Mr. Mukul Rohatgi, Sr. Advocate. He supported the amendments issued by TRAI. Mr. Rohatgi said no case for stay on the amendments is made out.
The court did not pass any interim order and has listed the matter for next hearing 8th February 2023. Newsroom Post
